Further changes to the Electrical and Clerks Awards - flexible work arrangements

As a result of a recent Full Bench decision, new model terms will be inserted into all Modern Awards including the Electrical, Electronic and Communications Contracting Award 2010 (Electrical Award) and the Clerks – Private Sector Award 2010 (Clerks Award).

These model terms relate to family flexible work arrangements in line with s65 of the Fair Work Act 2009.  These will require employers to consult and genuinely attempt to reach an agreement about any request for flexible work arrangements, taking into account the employee’s circumstances.  Where an employer refuses the request for a flexible work arrangement, they must provide a written response detailing the business grounds for the refusal, and any alternative arrangement the employer could provide to accommodate the employee’s needs.

The above amendments take effect from 1 December 2018.
